Jeffrey Lerner

Jeffrey Lerner’s practice focuses on patent litigation. Mr. Lerner has broad experience representing clients before federal district courts, the International Trade Commission, and the U.S. Court of Appeals for the Federal Circuit. He has tried cases in federal court and the ITC and has litigated in a broad array of different technology areas, including semiconductor devices, software technology, advanced materials, and pharmaceuticals. Mr. Lerner also has substantial experience representing clients in antitrust litigation and advising clients on various aspects of antitrust law. REPRESENTATIVE MATTERS Representing Shire in Hatch-Waxman patent litigation concerning FOSRENOL®, lanthanum-based phosphate binder. Representing Nycomed in Hatch-Waxman patent litigation concerning SOLARAZE®, a topical treatment for actinic keratosis. Represented Respondent Nintendo in a patent infringement action at the ITC brought by Hillcrest Laboratories involving the Wii. Represented Manheim Auctions, Inc. in patent litigation concerning software that permits internet users to participate in a live auction. Represented a leading issuer of credit cards in defending an antitrust action alleging a conspiracy among banks and Visa and MasterCard to foreclose banks from issuing American Express cards. Represented a leading issuer of credit cards in defending an antitrust action concerning chargebacks to merchants for fraudulent credit card transactions. Represented a pharmaceutical company in litigation concerning alleged false advertising of its cosmetic product by a televised shopping network. Clinton County Prison (3d Cir.): argued an appeal for an indigent prisoner regarding a denial of psychiatric treatment and the district court’s denial of appointment of counsel. State of Maryland v. Turay: successfully represented an indigent defendant against criminal charges brought by the State of Maryland. Doe v. Wooten (N.D. Ga.): representing an indigent prisoner who has been threatened and assaulted in reprisal for his cooperation in the investigation of a corrections officer.
