Jason C Raofield

Jason Raofield is a partner in the firm’s Washington, DC office concentrating in antitrust and commercial litigation, arbitration, and white collar defense. He has litigated cases involving a wide range of antitrust claims asserted by competitors, enforcement agencies, and private consumer class actions. Mr. Raofield also has significant experience handling commercial disputes involving breach of contract and fraud-based claims, and has represented clients in a variety of industries. REPRESENTATIVE MATTERS Defending a major financial institution in putative class action asserting Section 1 and state law claims based on alleged industry-wide conspiracy to rig bids at tax lien auctions. Represented a leading technology company in the mobile device industry in antitrust and breach of contract litigation arising from competitor’s assertion of Standard Essential Patents subject to FRAND licensing commitments. Represented Intel in Section 2 monopolization case brought by AMD alleging that Intel monopolized the microprocessor market through alleged loyalty rebates and other conduct. Successfully defended Schering-Plough in two-month trial in landmark “pay-for-delay” case brought by the Federal Trade Commission challenging Schering’s settlement of patent infringement cases against generic manufacturers. Obtained summary judgment for Schering-Plough in federal antitrust class actions based on patent litigation settlements challenged by the Federal Trade Commission. Represented a leading agriculture company in DOJ investigation involving allegations of monopolization based on “product hopping” and refusal to deal with a competitor. Represented pharmaceutical company in federal securities fraud class action alleging failure to disclose information relating to violations of current Good Manufacturing Practices and product recalls leading to a major FDA enforcement action. Obtained summary judgment for Rockwell-Collins in an attempted monopolization, tying and unfair competition case brought by a competitor alleging Rockwell withheld intellectual property and technical information necessary to interface with Rockwell’s avionics systems. Represented pharmaceutical and biotech companies in arbitration and mediation of product licensing disputes. Represented the Republic of Uruguay in international arbitration arising out of the failure of Uruguay’s largest private bank following a massive fraud committed by bank management. Obtained dismissal of federal securities class action against a pharmaceutical company, its CEO and its board of directors, alleging violations of Regulation FD and various other securities laws. Mr. Raofield also has been recognized in Who’s Who for his work in representing clients in white collar defense matters.
