Edmund R Schroeder

Edmund R. Schroeder is a senior counsel in Cadwalader’s New York office. Mr. Schroeder specializes in commodity law and general representation of entities engaged in all aspects of the commodities business. He has advised commodity clients in such matters as secured financing transactions, acquisitions and dispositions of commodity operations, compliance with CFTC regulations and obtaining no-action or exemptive relief from the CFTC. Mr. Schroeder has participated in the creation of new commodity exchange markets and clearing organizations. Working with litigation attorneys, he has represented commodity clients in federal and state civil actions and in CFTC enforcement proceedings. He has appeared as an expert witness in commodity litigation. In addition, Mr. Schroeder has represented clients before the United States Congress in seeking and opposing legislation. In 1975 and 1976, Mr. Schroeder served on an advisory committee to the Commodity Futures Trading Commission and since that time has testified before Congress on various commodity-related subjects. In 1976 he organized what is now called the Committee on Futures Regulation of The Bar Association of the City of New York and served as its Chairman until 1981, when he was appointed Chairman of what is now called the Committee on Futures Regulation of the American Bar Association. He served in that office until July of 1985. A subspecialty for Mr. Schroeder has been commodity broker insolvencies. He was counsel to the receiver in proceedings brought by the Commodity Futures Trading Commission against Volume Investors Corp., a futures commission merchant that was rendered insolvent because of losses incurred in the gold options market. He also served as receiver for X-Cel Commodities Corp. in a different CFTC. He worked extensively in the formulation of the provisions in the Bankruptcy Code relating to the bankruptcy of commodity brokers, and he has testified before Congress on the subject. Mr. Schroeder has lectured, conducted seminars and participated in panel discussions on commodities regulation for the Practicing Law Institute, the Chicago Kent College of Law, Columbia Law School, Columbia Business School, the New School and other organizations. In addition he has contributed a number of articles to legal and trade publications on various aspects of commodities regulation. Mr. Schroeder has served as a member of the Scarsdale Board of Education. He is currently Chairman of the Board of Education Through Music, Inc. and a member of the Board of the Orchestra of St. Luke’s, as well as being active in various other civic and charitable capacities. He holds an A.B. cum laude from Harvard College and an LL.B. from Harvard Law School. Before coming to Cadwalader, Mr. Schroeder was a partner in Lord Day & Lord, Barrett Smith.
